The terms that apply when you use Speel and shop with us.

These Website Terms and Conditions (“Terms”) apply to your use of the Speel website at speelkits.co.za (“Website”) and to purchases made through the Website.
The Website is operated by Speel (Pty) Ltd (“Speel”, “we”, “us” or “our”).
By accessing the Website, creating an account or placing an order, you agree to these Terms together with our Privacy Policy, Delivery and Shipping Policy, and Refunds and Returns Policy.
These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), where applicable.
Nothing in these Terms is intended to limit any consumer right that cannot lawfully be limited or excluded.

You may use the Website to browse Speel products, create a customer account and place orders.
When providing information to us, including during checkout or when creating an account, you agree to provide information that is accurate and complete.
Purchases must be made by an adult who has the legal capacity to enter into a transaction.
Speel products are intended for children but purchases through the Website are intended to be made by parents, guardians or other adults.
We take reasonable care to ensure that product descriptions, photographs, prices and other information displayed on the Website are accurate.
Because of differences in screens, photography, manufacturing or packaging, the appearance of a product may differ slightly from the images displayed on the Website.
All products are subject to availability.
If a product becomes unavailable after an order has been placed, we will contact you and, where appropriate, offer an alternative, advise you of a delay, or provide a refund.
All prices are displayed in South African Rand (ZAR).
Speel is not currently registered for Value-Added Tax (VAT), and prices therefore do not include VAT charged by Speel.
Delivery charges, where applicable, will be displayed during checkout before you place your order.
We may change prices from time to time. Any price change will not affect an order that has already been accepted by us.
If an obvious pricing or product-description error occurs, we reserve the right to correct the error and, where reasonably necessary, cancel an affected order. If payment has already been received for an order that is cancelled for this reason, the amount paid will be refunded.
Placing an order through the Website constitutes an offer by you to purchase the products selected.
Before placing your order, you will have an opportunity to review the products, quantities, delivery information and total amount payable and to correct information where necessary.
An order is accepted once we confirm acceptance of the order or begin processing or dispatching it.
We may decline or cancel an order where reasonably necessary, including where:

The payment methods currently available will be displayed during checkout.
Payments are processed through third-party payment service providers. Speel does not store customers’ complete payment-card details on its own Website systems.
By submitting a payment, you confirm that you are authorised to use the selected payment method.
An order will only be processed once the applicable payment requirements have been satisfied.
Orders are delivered in accordance with our Delivery and Shipping Policy, which forms part of these Terms.
Delivery charges and available delivery methods will be displayed during checkout where applicable.
Customers are responsible for ensuring that the delivery address, telephone number and other delivery information provided are accurate.
Estimated delivery periods are not guarantees, and delays may occasionally arise due to circumstances outside our reasonable control.
Where South African law provides additional rights relating to late or failed delivery, those rights remain unaffected.
Where applicable, consumers purchasing goods electronically have the cooling-off rights provided by ECTA.
Subject to applicable exclusions under the law, you may notify us that you wish to cancel an eligible purchase within seven days after receiving the goods.
The detailed process and conditions applying to these returns are contained in our Refunds and Returns Policy, which forms part of these Terms.
As explained in that policy, a change-of-mind return is intended to allow a customer to reasonably inspect a product and decide whether to keep it.
It is not intended to allow a Speel activity or play product to be substantially used for its intended play experience and then returned once it is no longer wanted.
Products should therefore be kept complete and cared for while you decide whether to keep them. The condition of returned products will be considered in accordance with applicable South African consumer law.
Nothing in this clause limits any statutory right relating to defective, unsafe, incorrectly supplied or incorrectly described goods.
Speel products are subject to the consumer protections and implied warranty of quality provided by the CPA.
Where goods fail to meet the standards required by the CPA, consumers may have the right, within the applicable statutory period, to return them and elect the remedy provided by law, which may include repair, replacement or refund.
This includes goods that are materially defective, unsafe or do not reasonably correspond with their description, subject to the provisions of the CPA.

Nothing in our Refunds and Returns Policy or these Terms limits a consumer’s rights under the CPA.
Speel products are designed to encourage activity-based, screen-free play.
Some activities may require or benefit from assistance from a parent, guardian or responsible adult.
In particular, children approximately two to three years of age should use Speel products with appropriate adult supervision and assistance, depending on the activity and the individual child.
Parents and guardians remain responsible for assessing whether a particular product or activity is appropriate for a child’s age, development and abilities and for providing reasonable supervision.
Although Speel products are designed with children in mind, ordinary safety precautions should always be followed when children are playing.
Any specific safety information, age guidance or instructions provided with a product should be followed.
Customers may create accounts on the Website.
You are responsible for keeping your login details confidential and for activities carried out through your account.
Please notify us if you reasonably believe that your account has been accessed without authorisation.
We may suspend or restrict an account where reasonably necessary to protect the Website, customers or Speel from fraud, misuse or security risks.
The collection and processing of personal information associated with customer accounts is explained in our Privacy Policy.
The Website may allow customers to submit ratings, written reviews and, in future, photographs or other content.
You may only submit content that you are entitled to provide and that is lawful, truthful and relevant to the product being reviewed.
We may moderate or remove content that is unlawful, abusive, misleading, offensive, unrelated to the product, infringes another person’s rights, contains inappropriate personal information, or otherwise violates these Terms.
Submitting a review does not automatically give Speel unrestricted permission to use identifiable photographs of customers or children in advertising or promotional campaigns.
Where we wish to use an identifiable customer’s or child’s photograph for promotional purposes, we may request appropriate additional permission.
Unless otherwise stated, the content of the Website, including the Speel name, logos, branding, written content, graphics, product photographs, designs and Website materials, belongs to or is licensed to Speel.
You may view and use the Website for personal and lawful purposes.
You may not reproduce, distribute, sell, commercially exploit or materially modify Speel’s Website content without permission, except where permitted by law.

If a consumer dispute cannot be resolved directly, you may have the right to approach an appropriate consumer protection body, including the Consumer Goods and Services Ombud or the National Consumer Commission.
These Terms and transactions concluded through the Website are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with by a court or other competent forum having jurisdiction under South African law.
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
A failure by Speel to enforce a provision of these Terms on one occasion does not amount to a permanent waiver of that provision.
